4. DEPOSITS AND ADVANCE PAYMENTS

non-refundable payments;

We will not automatically treat every deposit as non-refundable where applicable law requires otherwise.
Where a package booking is subject to statutory package travel rights, those rights will apply.
5. CANCELLATION CHARGES

7. CANCELLATION BECAUSE OF UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES
Where applicable package travel legislation gives you a right to terminate a package contract without paying a termination fee because unavoidable and extraordinary circumstances significantly affect the performance of the package or the carriage of passengers to the destination, that statutory right will apply.
The assessment will depend on the circumstances and applicable law.
Examples may include serious events at the destination that significantly affect the performance of the package or transportation to the destination.
8. CANCELLATION BY SHAARTH TRAVEL
SHAARTH Travel will not cancel a booking without a reasonable basis.
Where we need to cancel a service or booking, we will communicate with you as soon as reasonably possible.
Depending on the circumstances, we may:
offer an alternative arrangement;
offer a change of date;
offer an alternative service;
provide a refund where required; or
take another appropriate action.
Where package travel legislation applies, SHAARTH Travel will comply with the relevant statutory cancellation and refund requirements.
9. SIGNIFICANT CHANGES
If a significant change is required to a package or other booking, we will communicate the change and explain any rights that apply.
Where applicable law gives you a right to accept an alternative arrangement, reject the change or terminate the contract with a refund, those rights will apply.
10. SUPPLIER CANCELLATIONS

any statutory refund deadline that applies.
Where a statutory refund deadline applies, SHAARTH Travel will comply with that requirement.
12. PARTIAL REFUNDS
Where only part of a booking is cancelled or cannot be provided, the amount refundable will depend on:

amounts already paid to suppliers;

applicable booking terms; and
applicable statutory rights.

Travel plans may sometimes need to change after your journey has started.

weather;
transport disruption;
local conditions;
safety concerns;
attraction closures;
supplier changes;
government restrictions; or
other circumstances outside reasonable control.
SHAARTH Travel will seek to provide reasonable assistance and alternatives where practicable.
If you voluntarily choose to shorten an itinerary or remove services after the trip has started, a refund will not automatically be due.
However, this does not affect any statutory entitlement you may have.
15. NON-REFUNDABLE SERVICES
Some services may be sold on a non-refundable basis because the relevant supplier has imposed non-refundable terms.
Examples may include:
certain hotel rates;
airline tickets;
special event tickets;
private transportation;
certain excursions;
certain activity bookings; and
specially arranged services.
Where a non-refundable condition applies, we will communicate it before the booking is confirmed where reasonably possible.
A non-refundable supplier condition does not remove any statutory consumer rights that may apply.
16. NO-SHOWS

These Master Booking Terms & Conditions ("Booking Terms") apply to bookings and travel services arranged or provided by SHAARTH Travel ("SHAARTH Travel", "we", "us" or "our").
They apply together with the booking confirmation, invoice, itinerary and any specific terms communicated to you before your booking is confirmed.
If your booking is a package under applicable package travel legislation, the mandatory rights and protections applicable to package travel will also apply.
Nothing in these Booking Terms excludes or limits any statutory rights that cannot legally be excluded or limited.
2. OUR SERVICES
SHAARTH Travel may arrange or provide travel-related services including:
private tours;
group tours;
bespoke itineraries;
accommodation;
airport transfers;
transportation;
excursions;
activities;
destination management services;
travel consultancy; and
other travel-related services.
The exact services included in your booking will be stated in your quotation, itinerary or booking confirmation.
3. MAKING A BOOKING
Before making a booking, you should carefully check:

number of travellers;

5. PAYMENT

full payment in advance; or
payment directly to a third-party supplier.
Your booking confirmation will state the applicable payment requirements.
If payment is not received by an agreed deadline, SHAARTH Travel may treat the booking as cancelled where permitted by the applicable booking terms.

Unless expressly stated, a service is not included simply because it is commonly associated with a destination.

8. ACCURACY OF CUSTOMER INFORMATION

other information reasonably required to arrange your travel.
Additional costs arising from incorrect or incomplete information may be your responsibility where legally permitted.

immigration requirements;

cancellation;
travel interruption;
baggage;

11. ACCOMMODATION
Accommodation is subject to availability and the terms of the relevant accommodation provider.
Hotel facilities, room categories, opening hours and services may change.
Accommodation providers may have their own:

deposits;

age restrictions;
identification requirements;
local taxes; and
house rules.
You must comply with the accommodation provider's reasonable rules.
12. TRANSPORTATION
Transportation may be provided by independent third-party providers.
Schedules may change because of:
weather;
traffic;
mechanical problems;

government restrictions;
strikes;
road conditions; or
other circumstances outside reasonable control.
Where transportation is part of a package, applicable package travel rights will apply.
13. TOURS AND ACTIVITIES

You must follow the instructions of the relevant guide, driver, activity operator or other responsible person.
Certain activities may have:
age restrictions;

SHAARTH Travel may refuse participation where a supplier reasonably considers an activity unsafe or unsuitable.
14. CHANGES REQUESTED BY YOU

Additional costs may apply where:
suppliers charge amendment fees;
new services cost more;
transportation costs increase;
accommodation changes;
activities are added; or
other reasonable costs are incurred.
We will inform you of material additional costs before proceeding where reasonably practicable.
15. CHANGES TO ITINERARIES
Travel itineraries can sometimes be affected by circumstances beyond reasonable control.
Examples include:
weather;
road closures;
railway disruption;
cancelled flights;
attraction closures;
local events;
government restrictions;
safety concerns;
supplier changes; and
natural events.
We will seek reasonable alternatives where practicable.
16. CUSTOMER CANCELLATION
You may cancel your booking subject to the applicable cancellation terms.
The cancellation terms applicable to your specific booking will be provided with your booking information.
Cancellation charges must comply with applicable law.
17. CANCELLATION BY SHAARTH TRAVEL
If SHAARTH Travel needs to cancel a booking, we will communicate with you as soon as reasonably practicable.

18. PACKAGE TRAVEL
Where SHAARTH Travel combines two or more different types of travel service for the same trip and the arrangement meets the legal definition of a package, the Package Travel and Linked Travel Arrangements Regulations 2018 may apply.
Where those Regulations apply, SHAARTH Travel will provide the information, contractual rights and protections required by law.
The fact that services are listed together on an itinerary does not by itself determine whether an arrangement is legally a package.
19. SUPPLIER SERVICES
Many services are performed by independent suppliers.
SHAARTH Travel will select and coordinate suppliers with reasonable care.
Where SHAARTH Travel is legally responsible as the organiser of a package, the statutory organiser responsibilities applicable to that package will apply.
Where SHAARTH Travel acts only as an intermediary or booking agent, the supplier's contractual terms may also apply.
20. COMPLAINTS DURING YOUR TRIP
If you experience a problem during your trip, please contact SHAARTH Travel or the relevant supplier as soon as reasonably possible.
Prompt notification gives us a reasonable opportunity to investigate and, where possible, correct the problem.
You should keep evidence relating to any complaint, including:
photographs;
receipts;
messages;
booking information; and
relevant correspondence.
21. AFTER-TRAVEL ASSISTANCE
SHAARTH Travel aims to provide reasonable customer assistance before, during and after your trip.
You may contact us after your tour if you require reasonable assistance relating to your booking.
This does not mean that SHAARTH Travel accepts responsibility for matters outside our legal or contractual responsibility.
22. FORCE MAJEURE
Neither party should be treated as responsible for circumstances that could not reasonably have been prevented or avoided, subject to applicable law.
Examples may include:
natural disasters;
severe weather;
war;
terrorism;
civil unrest;
government restrictions;
pandemics;
strikes;
major transportation disruption;
border closures; and
other exceptional events outside reasonable control.
Where such circumstances affect your booking, we will act reasonably and in accordance with applicable law.
23. LIABILITY
Nothing in these Booking Terms excludes or limits liability where such exclusion or limitation would be unlawful.
This includes liability that cannot legally be excluded under applicable consumer law.

1. PURPOSE
SHAARTH Travel may arrange different types of travel services for customers.
Depending on how services are selected, sold and combined, an arrangement may constitute a package or linked travel arrangement under the Package Travel and Linked Travel Arrangements Regulations 2018.
This section explains our approach to arrangements that fall within those Regulations.
2. WHEN PACKAGE TRAVEL RULES MAY APPLY
A package may arise where two or more different types of travel service are combined for the same trip, subject to the detailed legal requirements.
Travel services can include:
passenger transport;
accommodation;
vehicle hire; and
certain other tourist services.
Whether an arrangement legally constitutes a package depends on the circumstances of the sale and the way the services are combined.
3. INFORMATION BEFORE BOOKING

5. ORGANISER RESPONSIBILITY
Where SHAARTH Travel is the legal organiser of a package, SHAARTH Travel will be responsible for the performance of the travel services included in that package in accordance with applicable law.
Where a service is not performed as agreed, the statutory rights applicable to the package will apply.
6. ASSISTANCE TO TRAVELLERS
Where required by the Regulations, SHAARTH Travel will provide appropriate assistance to a traveller experiencing difficulty during a package.
This may include reasonable assistance concerning:
health problems;
communication with local providers;
alternative arrangements;
travel disruption; or
other circumstances covered by applicable law.
7. CHANGES TO A PACKAGE
Where SHAARTH Travel proposes a significant change to a package, applicable statutory rights will apply.
Depending on the circumstances, the traveller may have rights to:
accept the proposed change;
accept an alternative package; or
terminate the package contract and receive the refund required by law.
8. PRICE CHANGES
Where permitted by the Regulations, a package price may be increased only in accordance with the statutory requirements.
Where a price increase is permitted, the traveller will be given the information and rights required by law.
9. CANCELLATION BY THE TRAVELLER
A traveller may have statutory rights to terminate a package before departure.
Where a cancellation charge applies, it must be determined in accordance with the applicable contract and law.
Where unavoidable and extraordinary circumstances significantly affect the performance of the package or transportation to the destination, statutory cancellation rights may apply.
10. TRANSFER OF A PACKAGE
Where applicable law permits a traveller to transfer a package contract to another person, SHAARTH Travel will comply with the relevant statutory requirements.
Reasonable costs associated with the transfer may apply where permitted by law.
11. INSOLVENCY PROTECTION
Where SHAARTH Travel is required to provide insolvency protection as a package organiser, the required protection must be established before relevant package sales are made.
The applicable protection must comply with the requirements of the Package Travel and Linked Travel Arrangements Regulations 2018.
Important: SHAARTH Travel should not represent a package as protected by ATOL, insurance, bonding, a trust arrangement or another insolvency-protection mechanism unless that protection has actually been arranged and applies to the relevant booking.
12. FLIGHT-INCLUDING PACKAGES
Where a package includes flights, additional legal and insolvency-protection requirements may apply.
SHAARTH Travel will only state that a flight-inclusive package is protected under a particular scheme where the relevant protection has actually been obtained.
13. LINKED TRAVEL ARRANGEMENTS
Some arrangements may constitute a Linked Travel Arrangement rather than a package.
Where applicable, SHAARTH Travel will comply with the legal requirements applicable to the particular arrangement.
14. CUSTOMER DOCUMENTATION
Where package travel legislation applies, customers will receive the documentation required by applicable law.
Customers should retain:
booking confirmations;
invoices;
itineraries;
package information;
supplier information; and
other travel documents.
15. STATUTORY RIGHTS
Nothing in this section limits statutory rights under the Package Travel and Linked Travel Arrangements Regulations 2018.
Where mandatory legislation provides a right or remedy greater than the terms of another SHAARTH Travel document, the statutory requirement will prevail.

You must not intentionally misuse or damage equipment.

1. PURPOSE
These Supplier Terms & Conditions ("Supplier Terms") apply to suppliers providing travel-related services to SHAARTH Travel.
A supplier may include:
hotels;
villas;
resorts;
drivers;
guides;
transport operators;
excursion providers;
activity operators;
restaurants;
local representatives;
destination management companies; and
other travel service providers.
2. SUPPLIER RESPONSIBILITIES
The supplier agrees to provide services:
professionally;
safely;
with reasonable care and skill;
in accordance with the confirmed booking;
in accordance with applicable law; and
in accordance with any agreed service standards.
3. CONFIRMED SERVICES
The supplier must provide the services confirmed by SHAARTH Travel.
Any material change should be communicated to SHAARTH Travel as soon as reasonably possible.
4. CUSTOMER INFORMATION
The supplier must use customer information only for legitimate purposes connected with providing the booked service.
The supplier should not:
sell customer information;
use customer information for unrelated marketing;
disclose customer information unnecessarily; or
retain customer information longer than reasonably necessary.
5. DATA PROTECTION
Where the supplier processes personal information on behalf of SHAARTH Travel, the parties should agree appropriate data-processing arrangements where required by applicable data protection law.
Suppliers must take reasonable measures to protect customer information.
6. CUSTOMER SAFETY
Suppliers are responsible for maintaining appropriate safety standards relevant to their service.
Where an activity presents a particular risk, the supplier should provide appropriate:
instructions;
equipment;
supervision;
warnings; and
safety procedures.
7. LICENCES AND PERMITS
The supplier is responsible for maintaining any licences, permits, registrations, insurance and approvals required to provide its services lawfully.
8. CHANGES AND CANCELLATIONS
Suppliers must notify SHAARTH Travel promptly of:
cancellations;
delays;
closures;
overbooking;
significant service changes;
safety issues; or
other circumstances affecting a confirmed booking.
9. OVERBOOKING
A supplier should not knowingly overbook a SHAARTH Travel customer.
If overbooking occurs, the supplier must immediately notify SHAARTH Travel and provide reasonable assistance in finding an appropriate alternative.
10. DRIVER AND GUIDE STANDARDS
Drivers and guides should:
behave professionally;
treat customers respectfully;
comply with local law;
drive safely where driving is involved;
avoid discriminatory or abusive behaviour; and
protect customer confidentiality.
11. COMMERCIAL TERMS
Rates, commissions, payment schedules and cancellation conditions will be agreed separately between SHAARTH Travel and the supplier.
Unless otherwise agreed in writing, the supplier should not charge the customer directly for services included in the confirmed SHAARTH Travel booking.
12. CUSTOMER COMPLAINTS
Suppliers must notify SHAARTH Travel promptly of serious customer complaints.
Where possible, suppliers should attempt to resolve operational problems immediately and reasonably.
13. FORCE MAJEURE
Neither party will be treated as responsible for circumstances genuinely outside reasonable control, subject to applicable law and the terms of the relevant supplier agreement.
14. CONFIDENTIALITY
Commercial information exchanged between SHAARTH Travel and the supplier should be treated as confidential unless disclosure is required by law or authorised by the relevant party.
15. TERMINATION
SHAARTH Travel may suspend or terminate cooperation with a supplier where the supplier:
repeatedly fails to provide agreed services;
creates serious safety concerns;
breaches applicable law;
misuses customer information;
engages in serious misconduct; or
materially breaches agreed commercial terms.
16. GOVERNING LAW
Unless otherwise agreed in writing, these Supplier Terms are governed by the laws of England and Wales.
Where the supplier is located outside the United Kingdom, the parties may agree additional local-law provisions in the individual supplier agreement.

1. TRAVEL INSURANCE
SHAARTH Travel strongly recommends that every traveller obtains appropriate travel insurance before departure.
Your insurance should be suitable for:
your destination;
the duration of your trip;
the activities you intend to undertake;
your personal circumstances; and
the value of your travel arrangements.
2. RECOMMENDED COVER
Depending on your circumstances, insurance may include:
emergency medical expenses;
cancellation;
travel interruption;
baggage;
personal liability;
missed departures;
delays;
repatriation;
adventure activities; and
other relevant risks.
3. PRE-EXISTING CONDITIONS
You should disclose relevant pre-existing medical conditions to your insurer where required by the insurer's policy.
SHAARTH Travel does not determine whether your insurance provides adequate medical cover.
4. ADVENTURE ACTIVITIES
If your itinerary includes adventure or higher-risk activities, check that your insurance specifically covers those activities.
Standard travel insurance may exclude certain activities.
5. CUSTOMER RESPONSIBILITIES
You are responsible for:
checking your passport;
obtaining required visas;
meeting entry requirements;
checking travel warnings;
obtaining appropriate insurance;
providing accurate booking information;
arriving on time for scheduled services;
complying with supplier instructions; and
behaving responsibly during your trip.
6. OFFICIAL TRAVEL INFORMATION
Travel requirements can change.
Customers should check official government sources for the destination and their nationality before travelling.
SHAARTH Travel may provide general guidance but cannot guarantee that third-party or government information will remain unchanged.
7. EMERGENCIES
In an emergency, contact the appropriate local emergency service first.
SHAARTH Travel may provide reasonable assistance where practicable but cannot replace emergency medical, police or other official services.
8. TRAVEL DOCUMENTS
Customers should keep copies of:
passports;
visas;
insurance documents;
booking confirmations;
emergency contacts; and
other important travel documents.

1. ABOUT THESE TERMS
These Package Holiday Booking Terms & Conditions ("Booking Terms") apply to package holidays organised and sold by SHAARTH Travel ("SHAARTH Travel", "we", "us" or "our").
These Booking Terms form part of the contract between you and SHAARTH Travel.
They should be read together with:
your quotation;
your booking confirmation;
your itinerary;
your invoice;
the package information provided before booking;
any specific terms relating to your particular package; and
any applicable statutory rights.
Where applicable, these Booking Terms are intended to operate alongside the Package Travel and Linked Travel Arrangements Regulations 2018, as amended and applicable from time to time.
Nothing in these Booking Terms is intended to exclude or restrict any statutory right that cannot legally be excluded or restricted.
2. WHO IS SHAARTH TRAVEL?
SHAARTH Travel is a travel business operating from England and Wales, United Kingdom.
SHAARTH Travel designs, arranges and sells bespoke and pre-designed holidays, including holidays involving combinations of:
accommodation;
transportation;
airport transfers;
private drivers;
tours;
excursions;
activities;
local guides; and
other tourist services.
Where an arrangement meets the legal definition of a package, SHAARTH Travel acts as the package organiser.
The UK Government describes organisers as traders who combine and sell packages, and the current framework places specific responsibilities on them.
3. YOUR CONTRACT WITH SHAARTH TRAVEL
When you purchase a package holiday from SHAARTH Travel for one total package price, you enter into a contract with SHAARTH Travel.
The contract consists of:
these Booking Terms;
the package description;
your itinerary;
the booking confirmation;
the agreed price;
the payment schedule;
the cancellation terms; and
any other information expressly incorporated into your booking.
The person making the booking is responsible for ensuring that all travellers receive and understand the relevant booking information.
4. WHAT IS A PACKAGE HOLIDAY?
A package holiday may consist of two or more different types of travel service combined for the same trip or holiday.
Travel services can include:
passenger transportation;
accommodation;
vehicle hire; and
certain other tourist services such as excursions, activities or attraction tickets.
Whether an arrangement constitutes a package depends on the circumstances in which the services are selected, combined and sold.
SHAARTH Travel will provide the applicable information and statutory protections where the booking falls within the Package Travel and Linked Travel Arrangements Regulations 2018.
The current government framework confirms that package organisers have responsibilities concerning the performance of the travel services included in the package and insolvency protection.
5. OUR PACKAGE HOLIDAYS
SHAARTH Travel may sell packages including, for example:
Sri Lanka
A package may include:
airport pickup;
private driver;
accommodation;
sightseeing;
excursions;
train journeys;
activities;
local guides; and
other agreed services.
Philippines
A package may include:
airport transfers;
accommodation;
island transfers;
private transportation;
boat trips;
island excursions;
activities;
guides; and
other agreed services.
The exact services included in your holiday will always be specified in your individual itinerary and booking confirmation.
6. THE PACKAGE PRICE
The total package price will be confirmed before you become bound by the booking.
Your package price may include the services specifically identified in your quotation and booking confirmation.
Unless expressly stated as included, the following may be excluded:
international flights;
visas;
travel insurance;
personal expenses;
tips;
meals not specifically listed;
optional excursions;
additional activities;
additional transportation;
excess baggage; and
other services not expressly included.
Your booking confirmation will identify the applicable inclusions and exclusions.
7. QUOTATIONS
A quotation is not normally a confirmed booking until SHAARTH Travel has accepted the booking and the required payment has been received.
A quotation may be subject to:
availability;
supplier confirmation;
price validity;
currency fluctuations;
specific booking deadlines; and
other conditions stated in the quotation.
The quotation will specify any deadline by which it must be accepted.
8. BOOKING CONFIRMATION
Once your booking has been accepted, SHAARTH Travel will provide booking confirmation and relevant package information.
You should check the information carefully and immediately notify us if anything is incorrect.
Particular attention should be paid to:
traveller names;
dates;
destinations;
accommodation;
room types;
transportation;
activities;
airport information;
inclusions;
exclusions;
payment deadlines; and
special requirements.
9. PAYMENT
The payment schedule will be stated in your quotation, invoice or booking confirmation.
Depending on the package, we may require:
a deposit;
staged payments; or
full payment.
A booking may not be considered fully confirmed until the required payment has been received.
If an agreed payment deadline is missed, SHAARTH Travel may take reasonable action in accordance with the booking terms and applicable law.
10. DEPOSIT
Where a deposit is required, the amount will be stated before the booking is confirmed.
The deposit may be used by SHAARTH Travel to secure travel services with suppliers.
If you subsequently cancel, the treatment of the deposit will depend on:
the applicable cancellation terms;
supplier charges;
costs already incurred;
the timing of the cancellation; and
applicable statutory rights.
A deposit will not automatically be treated as non-refundable where doing so would conflict with applicable law.
11. FINAL PAYMENT
Your booking confirmation will state when the remaining balance is due.
You are responsible for ensuring that the balance reaches SHAARTH Travel by the stated deadline.
Where payment is not received by the applicable deadline, we may contact you to resolve the matter before taking further action.
12. CHANGES TO THE PACKAGE PRICE
Once your booking has been confirmed, SHAARTH Travel will not increase the package price except where permitted by the applicable contract and law.
Where the Package Travel and Linked Travel Arrangements Regulations 2018 apply, any permitted price increase will be subject to the statutory requirements.
Where a statutory right applies because of a price increase or related change, that right will be respected.
13. YOUR RESPONSIBILITY FOR TRAVEL DOCUMENTS
You are responsible for ensuring that every traveller has the required travel documentation.
This may include:
valid passport;
visa;
entry permit;
transit permission;
immigration documentation;
health documentation where required; and
other documents required by the relevant authorities.
Requirements depend on your nationality and destination.
You should check official government sources before travelling.
14. TRAVEL INSURANCE
SHAARTH Travel strongly recommends appropriate travel insurance for every traveller.
Insurance should be appropriate for:
the destination;
the duration of the holiday;
the activities included;
the traveller's circumstances; and
the value of the trip.
We recommend considering cover for:
medical expenses;
emergency treatment;
repatriation;
cancellation;
travel interruption;
baggage;
delays;
personal liability; and
activities undertaken during the holiday.
15. SPECIAL REQUIREMENTS
If you have special requirements, you should tell us before booking wherever possible.
This may include:
dietary requirements;
accessibility requirements;
mobility requirements;
allergies;
medical requirements relevant to the holiday; or
other assistance requirements.
We will consider reasonable requests and communicate relevant requirements to suppliers where necessary.
We cannot guarantee that every request can be accommodated.
16. PASSPORT AND VISA INFORMATION
SHAARTH Travel may provide general information concerning passports and visas.
However, immigration and entry requirements can change.
You remain responsible for satisfying the entry requirements applicable to your nationality.
Failure to obtain the required documentation may result in you being unable to travel.
Any resulting costs will depend on the circumstances and applicable law.
17. ACCOMMODATION
Accommodation included in your package will be identified in your booking confirmation.
Accommodation may be subject to the hotel's own reasonable rules, including:
check-in and check-out requirements;
identification requirements;
security deposits;
local taxes;
minimum-age requirements;
smoking restrictions; and
other reasonable conditions.
Hotel facilities and services may occasionally be unavailable because of maintenance, weather, operational circumstances or other reasons.
Where a significant issue affects the package, SHAARTH Travel will deal with it in accordance with applicable law.
18. PRIVATE DRIVERS AND TRANSPORTATION
Where your package includes a private driver or transportation, the relevant service will be described in your itinerary.
Drivers may provide transportation and reasonable assistance with:
navigation;
communication;
local information;
agreed sightseeing stops; and
practical travel arrangements.
Drivers are not automatically professional tour guides unless this is expressly included in your booking.
Transportation times are estimates and may be affected by:
traffic;
road conditions;
weather;
accidents;
road closures;
local events;
vehicle problems;
government restrictions; and
other circumstances outside reasonable control.
19. TOURS, EXCURSIONS AND ACTIVITIES
Your itinerary will identify activities and excursions included in your package.
Some activities may be operated by independent specialist suppliers.
Activities may involve inherent risks, including:
swimming;
boating;
snorkelling;
diving;
hiking;
trekking;
cycling;
motorbike or scooter travel;
wildlife activities;
water sports; and
other adventure activities.
You must follow reasonable safety instructions given by the relevant supplier.
20. CHANGES TO YOUR ITINERARY BEFORE DEPARTURE
You may request changes to your itinerary before departure.
We will consider requests where reasonably practicable.
Changes may result in:
additional supplier charges;
a change in accommodation;
a change in transportation;
additional activity costs;
different availability; or
other reasonable costs.
We will explain material additional costs before implementing a requested change where reasonably practicable.
21. CHANGES TO YOUR PACKAGE BY SHAARTH TRAVEL
Circumstances may occasionally require us to make changes to your package.
Examples may include:
hotel availability;
transportation disruption;
attraction closure;
weather;
safety concerns;
supplier failure;
government restrictions;
local events; or
other circumstances outside our reasonable control.
Where a change is significant and applicable package-travel legislation gives you specific rights, we will provide the information and options required by law.
22. MINOR CHANGES
Not every change to an itinerary will be considered significant.
For example, a minor change to:
sightseeing order;
pickup time;
restaurant;
route;
activity timing; or
similar operational detail
may be necessary to operate the holiday.
We will seek to minimise inconvenience and provide reasonable alternatives where appropriate.
23. SIGNIFICANT CHANGES
Where a significant change is required to your package, we will notify you as soon as reasonably practicable.
Where required by law, you may have the right to:
accept the proposed change;
accept an alternative package; or
terminate the contract and receive the applicable refund.
The specific rights available will depend on the circumstances and applicable legislation.
24. CANCELLATION BY YOU
You may cancel your package before departure.
The amount payable on cancellation will depend on:
the date of cancellation;
the services included;
costs already incurred;
supplier cancellation charges;
the agreed cancellation terms; and
applicable law.
Cancellation charges will be communicated as part of your booking information.
Where package travel legislation provides a statutory right to cancel without a termination fee in particular circumstances, that right will apply.
25. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES
Where applicable package-travel legislation gives you the right to terminate your package without paying a termination fee because unavoidable and extraordinary circumstances significantly affect:
the performance of the package; or
carriage of passengers to the destination,
that statutory right will apply.
Whether such circumstances exist will depend on the specific facts and applicable law.
26. CANCELLATION BY SHAARTH TRAVEL
SHAARTH Travel may cancel a package in circumstances permitted by law.
If we cancel, we will explain the reason and provide the options and refunds required by applicable law.
Where appropriate, this may include:
an alternative package;
a different travel date; or
a refund.
27. SERVICES PROVIDED BY THIRD PARTIES
Your package may include services provided by independent suppliers.
These may include:
hotels;
airlines;
drivers;
guides;
boat operators;
excursion companies;
activity providers; and
local destination partners.
Although third parties may perform individual services, where SHAARTH Travel is the organiser of the package, our legal responsibilities as organiser will apply in accordance with applicable law.
The current government guidance specifically explains that package organisers can be responsible for the performance of the travel services forming the package even when those services are performed by third parties.
28. PROBLEMS DURING YOUR HOLIDAY
If something is not provided as agreed, please contact SHAARTH Travel or the relevant representative as soon as reasonably possible.
Prompt notification gives us an opportunity to investigate and, where possible, remedy the problem.
Where applicable law requires us to provide a remedy, we will comply with those requirements.
29. ASSISTANCE DURING YOUR HOLIDAY
Where required by applicable package-travel legislation, SHAARTH Travel will provide appropriate assistance if you experience difficulty during your holiday.
Depending on the circumstances, assistance may include:
helping you communicate with local authorities;
helping you communicate with suppliers;
providing information about health services;
helping arrange alternative travel arrangements; or
providing other reasonable assistance required by law.
30. IF YOU CHOOSE TO CHANGE YOUR HOLIDAY WHILE TRAVELLING
You may request changes after your holiday has started.
For example, you may request:
fewer destinations;
removal of an excursion;
an earlier departure;
different accommodation; or
a shorter itinerary.
We will consider such requests where reasonably practicable.
Where you voluntarily choose to remove or shorten services, there is no automatic entitlement to a refund unless required by the booking terms or applicable law.
Additional services requested during the holiday may incur additional charges.
The applicable additional price will be communicated before the additional service is accepted where reasonably practicable.
31. TRANSPORT DISRUPTION
Transport services may be affected by:
weather;
traffic;
mechanical problems;
strikes;
cancellations;
delays;
airport restrictions;
railway disruption;
road closures; or
other operational circumstances.
Where the disruption affects your package, SHAARTH Travel will provide reasonable assistance and remedies required by applicable law.
32. WEATHER AND NATURAL EVENTS
Travel in destinations such as Sri Lanka and the Philippines can be affected by tropical weather, monsoons, storms, flooding, landslides and other natural events.
SHAARTH Travel will take reasonable steps to protect travellers and adjust arrangements where necessary.
Safety will take priority over maintaining an original itinerary where circumstances make an activity or route unsafe.
33. TRAIN JOURNEYS AND OTHER THIRD-PARTY SERVICES
Where your package includes a train journey or another service operated by an independent provider, the service may occasionally be:
delayed;
cancelled;
rescheduled;
overcrowded;
altered; or
otherwise disrupted.
For example, Sri Lanka Railways may cancel or change a scheduled train.
Where this occurs, SHAARTH Travel will seek a reasonable alternative where practicable.
If a supplier fails to provide a service forming part of a package, SHAARTH Travel will deal with the matter in accordance with the applicable package-travel obligations.
34. COMPLAINTS
If you have a complaint during your holiday, please contact us as soon as reasonably possible.
You should give us a reasonable opportunity to resolve the problem while you are travelling.
After your holiday, written complaints should be submitted as soon as reasonably practicable and should include relevant supporting information.
35. REFUNDS
Where a refund is due under your contract or applicable law, SHAARTH Travel will process it within the applicable legal timeframe.
Refunds will normally be made using the original payment method where reasonably possible.
Where a supplier is involved, SHAARTH Travel remains responsible for complying with any statutory refund obligation applicable to the package.
36. TRANSFER OF YOUR BOOKING
Where applicable law permits you to transfer your package to another traveller, SHAARTH Travel will comply with the relevant legal requirements.
Reasonable costs associated with a permitted transfer may apply where allowed by law.
37. TRAVELLER CONDUCT
You are responsible for behaving reasonably during your holiday.
You must:
respect local laws;
follow reasonable safety instructions;
respect accommodation rules;
respect other travellers;
avoid abusive or threatening behaviour; and
avoid behaviour that creates a serious safety risk.
Where a traveller's conduct creates a serious safety risk, suppliers may take reasonable action.
Nothing in this clause removes any statutory rights.
38. TRAVEL INSURANCE
Travel insurance is strongly recommended.
SHAARTH Travel does not provide a substitute for appropriate travel insurance unless expressly stated otherwise.
You are responsible for checking that your policy covers your circumstances and activities.
39. PERSONAL DATA
SHAARTH Travel processes personal information in accordance with our Privacy Policy.
Because your package may involve suppliers outside the UK, relevant personal information may need to be shared with hotels, drivers, guides, activity providers and other suppliers necessary to perform your holiday.
40. INTERNATIONAL TRAVEL
Because SHAARTH Travel operates international holidays, some services may be performed outside the United Kingdom.
Local laws and regulations may differ from those in the UK.
Travellers are expected to comply with applicable local laws and reasonable supplier requirements.
41. INSOLVENCY PROTECTION
SHAARTH Travel will maintain the insolvency protection required by applicable package-travel legislation for packages sold where such protection is required.
The protection must be capable of covering applicable customer refunds and, where required, repatriation.
42. FLIGHT-INCLUSIVE PACKAGES
If SHAARTH Travel sells packages including flights, additional legal requirements may apply.
43. LIMITATION OF LIABILITY
Nothing in these Booking Terms excludes or limits liability that cannot legally be excluded or limited.
Nothing in these Booking Terms limits your statutory rights under applicable consumer or package-travel legislation.
Where SHAARTH Travel is responsible for the proper performance of the travel services forming a package, the applicable statutory liability provisions will apply.
44. SUPPLIER FAILURE
If a supplier fails to provide a service forming part of your package, SHAARTH Travel will assess the circumstances and take appropriate action.
Where required by package-travel legislation, we will provide an appropriate remedy or alternative arrangement.
SHAARTH Travel may subsequently seek recovery from the responsible supplier where permitted by law.
45. FORCE MAJEURE
SHAARTH Travel will not be responsible for circumstances that could not reasonably have been avoided or overcome, except where applicable law imposes a specific obligation or remedy.
Such circumstances may include:
natural disasters;
severe weather;
war;
terrorism;
civil unrest;
government action;
epidemics or pandemics;
strikes;
border closures;
major transport disruption;
infrastructure failure; and
other exceptional events outside reasonable control.
46. CHILDREN AND MINORS
Some hotels, activities and transportation providers may impose age restrictions.
The person making the booking is responsible for providing accurate ages of travellers where required.
Where a minor travels as part of a booking, the parent, guardian or responsible adult remains responsible for ensuring that appropriate consent and documentation are available.
47. PHOTOGRAPHY AND MEDIA
SHAARTH Travel may occasionally photograph or record tours for promotional purposes.
We will not use identifiable customer images for marketing without an appropriate lawful basis and, where required, consent.
You may contact us if you have concerns about the use of your image.

By confirming your booking, you acknowledge that:
you have received the relevant booking information;

the information provided to SHAARTH Travel is accurate;
you understand the services included in your package;
